Conditions of Probation

Evaluation/Treatment

An evaluation is a screening tool designed to reveal whether or not a person is engaging in harmful or risky behaviors.  An evaluation is designed to detect problems early on, so that you can receive treatment.  These evaluations are completed by a mental health professional that is certified in the specific area of concern.  All criminal history and alcohol/drug consumption must be included in the evaluation.

All recommendations in the evaluation must be completed. Evaluation and treatment can not be completed online or over the phone.

Alcohol and Drug Evaluation

The evaluation must be completed by a Certified Addiction Counselor.  The following website will allow you to search for a Certified Addiction Counselor in your area.

Georgia's DUI Intervention Program will also provide you with a list of acceptable counselors to complete any treatment that is recommended.

Once you have completed the evaluation, it is important that you have the full evaluation sent to your Probation Officer. Make sure that your name, case number, and the name of your Probation Officer is on the evaluation.  It is also important that you keep a copy of the evaluation for yourself.  Read over it and understand the treatment recommendations, so you can begin treatment immediately.

Anyone, who has been convicted of a DUI, must use a counselor from the above website.  Your treatment must also be completed by one of the listed counselors.

Anger and Violence Evaluation

The evaluation must be completed by a counselor certified in anger and violence counseling. The following website will allow you to search for a counselor in your area.

Georgia's DUI Intervention Program will also provide you with a list of counselors to complete any treatment that is recommended.

Make sure that your name, case number, and the name of your Probation Officer is on the evaluation. It is also important that you get a copy of the evaluation for yourself. You need to read over it and understand the treatment recommendations so you can start them immediately.

Deviant Behavior/Psychosexual Evaluation

This type of evaluation is used to assess individuals who have been charged with or convicted of certain sexual or deviant behavior-related offenses.

The evaluation is conducted by a licensed mental health professional and helps determine risk factors, treatment needs, and appropriate supervision levels. The full evaluation should be sent to your probation officer and include your name/case number.

Important: After the evaluation, probationers should follow up with the provider or their officer to find out if treatment is recommended—and if so, begin treatment as soon as possible to avoid delays or non-compliance. Monthly treatment attendance updates should be provided to the probation officer.

Psychological Evaluation

The evaluation must be completed by a Psychiatrist/Psychologist. This evaluation will be an assessment of your overall mental health and development.

Make sure that your name, case number, and the name of your Probation Officer is on the evaluation. It is also important that you get a copy of the evaluation for yourself. You need to read over it and understand the treatment recommendations so you can start treatment immediately.

Family Violence Intervention Program

The Family Violence Intervention Program is a 24-week course held once per week in a group setting, designed for individuals who have been involved in family or domestic violence situations. Family Violence Intervention is not the same as Anger Management.

The goal of FVIP is to help participants learn how to manage anger, take responsibility for their actions, and develop healthy, non-violent relationship skills.

Key points about FVIP:

  • Must be completed through a certified provider. See the list of all approved Family Violence Intervention Programs in Georgia. https://gcfv.georgia.gov/locations/certified-family-violence-intervention-program
  • Classes may be attended in person or virtually (Zoom or other approved platforms). No online programs are accepted.
  • Attendance is mandatory once enrolled.
  • A certificate of completion must be submitted to the probation officer after course completion.

 Important: Missing multiple sessions could get you dropped from the program requiring you to start the entire 24 course over.

Inpatient Treatment

If you are ordered by the court or as recommended in your evaluation to enter into an inpatient treatment facility, the inpatient treatment facility must be approved by the Judge or your Probation Officer.

Program Information

Once you enter the program, you are expected to complete the program. Leaving the program before you are properly discharged will result in a revocation of your probation. You are also responsible for supplying your Probation Officer with monthly updates of your progress.

Georgia Association of Recovery Residences will supply you with a list of inpatient facilities that have been approved by the court. It is rare for your Probation Officer to approve an inpatient facility located outside the state of Georgia because of extradition purposes. These will need to be approved by the Judge.

Risk Reduction Program

Program Information

The Risk Reduction Program, also known as DUI School, is required for individuals convicted of DUI, drug-related driving offenses, and certain other violations.

Key Information:

  • The program includes a mandatory assessment and a 20-hour class.
  • Classes may be completed in person or virtually through a DDS-certified provider. No online classes are accepted.
  • You can find a list of Risk Reduction Programs on the Georgia Department of Driver Services website.  If you live out of state, this website will also help you find an equivalent Risk Reduction Program in your home state.
  • A copy of the certificate of completion must be turned in to your probation officer after course completion.
  • If your license was suspended, you will need to keep the original to give to the Department of Drivers Services.

Defensive Driving

Program Information

This is a 6-hour class approved by the Georgia Department of Driver Services (DDS). A complete listing of Defensive Driving classes can be found on the Georgia Department of Drivers Services Website. https://online.dds.ga.gov/ddsgeorgiagov/locations/driver-improvement-schools.aspx

Key Information:

  • Format: In person or virtual through a DDS-certified provider. No online courses are accepted.
  • Certificate of completion must be submitted to your probation officer.

 

Theft and Shoplifting Offenders Program

Program Information

This program is designed for individuals charged with theft or shoplifting offenses. It aims to address the underlying causes of such behaviors and prevent future incidents.​

Key Information:

  • Class must be a minimum 3-hour class. 
  • Offered both in-person and virtually, depending on the provider.​ No online or self-paced classes are accepted unless it is done by Zoom/virtual with a live instructor.

Once you have completed the class you will need to provide a certificate of completion to your probation officer. We offer a list of Theft and Shoplifting Offender Programs in the Metro Atlanta Area.

 

Alcoholics Anonymous/Narcotics Anonymous

Resources

AA or NA meetings may be required as part of your probation conditions. These meetings support recovery from alcohol or drug use and help build a healthier lifestyle. Meetings must be properly documented using the Verification of Court Mandated Attendance of AA Meetings Form to include the name of the group, date and time of attendance and must be signed by the chairperson.

Victim Impact Panel

A Victim Impact Panel is a short class or presentation where probationers hear from victims or survivors whose lives have been affected by crimes such as drunk driving or other offenses.

The purpose of the panel is to help probationers understand the real-life impact of their actions, take personal responsibility, and reduce the chances of repeating harmful behavior.

MADD or Mothers Against Drunk Driving originally established this program. Other organizations and counseling facilities have branched out with new Victim Impact Panels. Victim Impact Panels can be completed in person, by Zoom, or through other approved virtual platforms. It's important to make sure the panel provider is approved by the court or probation officer before attending.

After completing the panel, probationers will receive a certificate of completion, which must be turned in to their probation officer.

Panel Information

The Judges of Cobb County State Court also order defendants, who have been convicted of other alcohol and drug related crimes, to attend this panel because of the valuable information that is presented.

Mothers Against Drunk Drivers (MADD) originally established this program.  Other organizations and counseling facilities have branched out with new Victim Impact Panels.  You can go to any Victim Impact Panel as long as it is in person.

The Victim Impact Panel can not be completed online.  Credit for an online panel will not be given unless it is done by Zoom/virtual with a live instructor.  The only exception for online is MADD due to your picture being on the completion certificate.

Community Service Work

Community Service Information

If Community Service work is required as part of your probation, the following guidelines must be followed to receive credit.

  • All hours must be completed in person with a registered 501(c)(3) nonprofit. In order to check an organization to see if it is considered a 501(c)3, you can go to the Georgia Secretary of State website.
  • No online Community service work is allowed. You cannot “pay” or donate goods in lieu of working. One hour work = One hour credit.
  • Timesheets are not accepted as proof of completion. You MUST have the organization write a letter on their business letterhead. The letter must include the number of hours that you have completed and what you did for the organization. It must also be an original document with an ink signature and contact number so it can be verified by  probation.
  • Letters must be presented in person or mailed to the probation office—no emails, faxes, or copies will be accepted.
  • Submitting false/forged community service documentation may result in a warrant for your arrest.

  • HMI Soup Kitchen
  • Dove Car Renaissance and Empower Ministry, Inc
  • Logan Social Services
  • Anger Works, USA
  • Alliance of Dreams

Fine/Restitution/Fee

Payments are to be made to the Cobb County State Court Clerk’s Office on the 2nd floor of the State Court Building or mailed to: Cobb County State Court Clerk – SEU Payments, 12 East Park Square, Marietta, GA 30090.   

 Payment slips must accompany payments that are sent in the mail.  Cash, debit or credit cards (Mastercard and Visa) are accepted, if paying in person with the card holder present.  Money orders or certified checks, made payable to the Clerk of Cobb County State Court, are also acceptable.  Be sure to include your case number with all payments.  

Your fine/restitution and fee are collected separately.  You will need to note how much you are paying for fine/restitution and Probation fees when making your payments.  It is also very important that you provide the case number so that the money is applied to the correct case. 

Alcohol and Drug Testing

When you are told to submit to testing, you are to submit to a urine test.  The test must check your urine for drugs and alcohol, unless otherwise specified by your Probation Officer.  You must submit to a standard drug panel and ETG (test for alcohol use for up to 72 hours).  The test must be witnessed and the results sent to your Probation Officer.

When you signed up for probation, you signed a Urine Abstinence Testing and Incidental Alcohol Exposure Form.   This form will give you a list of things that you will need to avoid or limit your contact with while on probation.  If you choose to use a different lab, the lab must abide by these requirements.  Some Judges require you to use the Cobb County Drug Treatment Lab for all testing.  Be sure to check with your Probation Officer.

Do not consume excessive amounts of liquids before testing, for this will cause your sample to be diluted. Diluted tests = Failed tests.

In-Home Incarceration

In-home incarceration is in lieu of serving jail time in the Cobb County Adult Detention Center.

More Information

At the time of sentencing, the Judge can order in-home incarceration.  You may receive a sentencing sheet that has Addendum “A” Additional Conditions of Probation near the top.  This sheet outlines, in detail, the requirements of your in-home incarceration. You are to give a copy of this sheet to the in-home incarceration monitoring company that you choose to use.  Deviating from the requirements on this form will result in a warrant for your arrest and a revocation of your probation.

The in-home incarceration monitoring company that you choose must submit weekly updates to your Probation Officer.  You are responsible for making sure the updates are sent to your Probation Officer.  Failure to submit these updates will result in a warrant for your arrest and a revocation of your probation.

Abandonment

If you are under a suspended sentence for abandonment, it is your responsibility to provide your Probation Officer proof that you are paying your child support.  If you have not set up payments through a child support service, you will need to do so immediately.  Failure to provide proof of your payment history will result in the revocation of your probation and jail time.

You are to read the article and write a 2 paragraph essay on what you have learned from it. Make sure that it is written legibly.

STD/AIDS test

This is a test for sexually transmitted diseases to include an AIDS test. Check with your Primary Care Physician or your local health department for testing.

Parenting Class

Parenting classes provide parents, stepparents and guardians with new methods to motivate, encourage, and discipline children. These classes strive to improve family relationships while providing guidance for raising children. You can contact local counseling facilities or DFACS for parenting classes in your area. The divorcing parent seminar is NOT considered a parenting class.

Gun Safety

The gun safety course will teach you how to properly handle and store firearms. You can find a gun safety course at some of your local gun ranges and firearm distributors. You can also check the National Rifle Association website or contact your state’s Fish and Game Department for information on gun safety courses in your area.

Ignition Interlock

The ignition interlock is connected to the ignition system of your vehicle and requires a passing breath test before the vehicle can be started. The device also requires random tests while operating the vehicle. You can find a list of Georgia Ignition Interlock providers at dds.ga.gov. If you live outside the state of Georgia, contact your local Department of Driver Services for approved providers in your area.

Delayed Report to Cobb County Adult Detention Center

The Judge has given you a specific time and date to report to the Cobb County Adult Detention Center. If you fail to report, a warrant will be issued for your arrest. It is very important that you take your Sentence Sheet with you to the jail so they will know the amount of time ordered by the Judge. Make sure to read the Delayed Report Instructions before reporting to the jail. The Cobb County Adult Detention Center is located at:
